Manpower Mobility Policy

The Wisconsin Pipe Trades Association adopts this Manpower Mobility Policy to assure that it is acting consistent with the United Association Constitution and at the same time address the policies which may require freedom in the movement of manpower.
These policies include:
- The need to retain and increase UA market share in Wisconsin.
- The need to assure a sufficient qualified workforce for available work.
- The need to have an adequate contractor base to bid on available work.
- The need to address loss of market share in industry segments.
Manpower Mobility shall be permitted under the following guidelines:
1) The Wisconsin Pipe Trades Executive Committee (“Committee”) shall establish a list of contractors eligible for Manpower Mobility. The Committee may add to and remove contractors from the list when in its judgment that is in the best interest of the membership. A contractor who is excluded from the list may appeal to the UA International Representative or his designee.
2) A contractor seeking Manpower Mobility for a project shall apply, on a form approved by the Committee, to the Local Union Business Manager for the area where the project is located. The Business Manager shall approve or reject the application within 14 days of its receipt. The failure to approve an application may be appealed to the UA International Representative or his designee.
3) Where Manpower Mobility is approved, the following rules shall apply:
- a. Only building trades journeypersons and apprentices who have been employed by the contractor for at least 4 weeks may travel to the project
- b. The contractor shall provide a list of all persons working on the project. Persons traveling to the project shall comply with Section 219 of the UA Constitution.
- c. Persons traveling to the project shall pay working assessment and/or travel card dues to the Local Union in the area where the project is located.
- d. The contractor shall comply with the terms and conditions of the Area Labor Agreement of the UA Local Union where the project is located. Fringe benefit contributions shall be submitted to the Funds provided for in the Area Labor Agreement and promptly remitted to the employee’s home Fund in accordance with established reciprocity agreements. Where the home fund contribution rate is higher, the contractor shall make contributions at the higher rate.
- 4) The Committee shall hear grievances/complaints arising from this policy and shall take such action which, in its judgment, is in the best interest of the membership.
This Manpower Mobility Policy will not apply to projects that have locally negotiated Project Labor Agreements, National Agreement Industrial Projects, or jobs where Market Recovery money has been granted by the Local Union.
